PRACTCE AREAS

  1. DIVORCE
Whether you and your partner agree it’s time to go your separate ways, or you have arrived at that conclusion on your own, consulting an attorney to explore the various options available to you can be time well spent. There are various “types” of divorces which require different paperwork, different processes and varying amounts of time and effort. Some of the factors that contribute to the differences are:
    • Do both parties want the divorce and will they be cooperative and amicable through the process?
    • Do both parties agree on the terms of the divorce?
    • Are children involved?
    • Is Property involved?
    • Is there a claim for alimony?

We handle all stages of a divorce, from the initial filing or responding to a summons you’ve been served with, through post-judgment requests for modification or enforcement. We handle all matters related to and arising out of divorce, including child custody and visitation, child support, alimony or spousal support and the division of marital property.

If you have been served with a summons and accompanying petition for dissolution of marriage be aware that there is a time frame within which you must respond (usually 20 days from the date you were served). Failure to respond, or failure to respond within the established timeframe may result in your forfeiting some or all of your rights in the case.

  2. CHILD CUSTODY
Often times when unmarried adults who have children go their separate ways, the parent who does not have custody of the children may feel helpless and at the mercy of the other parent when it comes to being able to see their children. If you are in this situation you have rights as a parent.

We handle all aspects of child custody and parental time sharing issues including responding to a summons you’ve been served with, filing the initial paperwork to get your case started, drafting parental time sharing agreements, and taking your case all the way to trail if necessary.

In general, when making a child custody/parental time sharing decision the Court focuses on the best interest of the child. Click Here to learn more about the Florida Statute governing child custody and parental time sharing (Florida Statute 61.13).

  3. CHILD SUPPORT
In most situations both parents, whether they are together or not, are obligated to provide financial support for their children. The State of Florida has established child support guidelines which are used to calculate the financial obligation which among other things considers the income of both parents and the number of minor children.

If you have been served with a summons and accompanying petition to establish child support from an attorney or from the Department of Revenue be aware that there is a time frame within which you must respond (usually 20 days from the date you were served). Failure to respond, or failure to respond within the established timeframe may result in your forfeiting some or all of your rights in the case.
